These Terms of Use ("Terms") govern your access to and use of the website at www.daffanny.com, including its pages, tools such as our size guide and bra size calculator, account features, newsletters and any related online services (together, the "Site"), operated by Daffanny ("Daffanny", "we", "us" or "our"). Purchases made through the Site are also governed by our Terms of Service and Shipping & Returns policy, and our collection and use of personal data is explained in our Privacy Policy.

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site. You must be at least 18 years old, or the age of majority where you live if higher, to create an account or make a purchase.

1. License to Use the Site

Subject to your compliance with these Terms, Daffanny grants you a limited, personal, non-exclusive, non-transferable and revocable license to access and use the Site for your own personal, non-commercial purposes, such as browsing our collections, checking sizing, managing your account and purchasing products for yourself or as gifts.

You may view, and print or download single copies of, pages of the Site for your own reference, provided you do not remove any copyright, trademark or other proprietary notices. Any other use, including reproducing, distributing, modifying, publicly displaying, selling or creating derivative works from any part of the Site, requires our prior written consent. This license does not transfer ownership of any content to you, and all rights not expressly granted are reserved by Daffanny.

2. Acceptable Use

We want the Site to be a welcoming, respectful and safe place to shop for intimate apparel. When using the Site, you agree not to:

• use the Site in any way that breaches applicable local, national or international law;
• use robots, spiders, scrapers or other automated tools to access, monitor, copy or extract content, prices or data from the Site, except for standard search engine indexing that respects our robots.txt file;
• attempt to gain unauthorized access to the Site, our servers, databases or any account that is not yours;
• upload or transmit viruses, malware or any other harmful code, or carry out denial-of-service or similar attacks;
• probe, scan or test the vulnerability of the Site or bypass any security or authentication measures;
• impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• post or send content that is unlawful, defamatory, harassing, hateful, sexually explicit, discriminatory or that invades another person's privacy;
• collect or harvest personal information about other users;
• send unsolicited advertising, spam or chain messages through any feature of the Site;
• frame or mirror the Site, or use our content to train, build or benchmark competing products or datasets without permission; or
• interfere with other users' enjoyment of the Site or with its proper functioning.

We may investigate suspected breaches and cooperate with law enforcement authorities where appropriate.

3. Accounts and Security

Some features, such as order history, saved addresses and wish lists, require an account. When you register, you agree to provide accurate, current and complete information and to keep it up to date. You may only hold one personal account and may not share it with others or use another person's account.

You are responsible for maintaining the confidentiality of your password and for all activity that takes place under your account. We recommend using a strong, unique password and logging out on shared devices. If you believe your account has been compromised, change your password immediately and let us know at [email protected].

We use reasonable technical and organizational measures to protect the Site and your data, as described in our Privacy Policy. However, no online service is completely secure, and you share information at your own risk. You can ask us to close your account at any time by contacting customer care.

4. Intellectual Property and Trademarks

All content on the Site, including text, product descriptions, photographs, videos, illustrations, graphics, logos, icons, page layouts, the size guide and bra size calculator, software and the selection and arrangement of these materials, is owned by or licensed to Daffanny and is protected by copyright, trademark, design and other intellectual property laws worldwide.

"Daffanny", the Daffanny logo and related names, slogans and trade dress are trademarks of Daffanny. You may not use them in connection with any product or service that is not ours, in any manner likely to cause confusion, or in any way that disparages or discredits Daffanny, without our prior written permission. Other trademarks that appear on the Site belong to their respective owners.

Our product designs, prints and lace patterns are part of our creative work. Reproducing product photography for resale listings, marketplaces or other stores is strictly prohibited.

5. User Submissions

The Site and our social media channels may allow you to submit or share content, including product reviews and ratings, fit feedback, photos, questions, messages sent through our contact form or by email, and posts on social platforms that tag or mention Daffanny or use our hashtags (together, "Submissions").

Your responsibilities

You are solely responsible for your Submissions. By providing a Submission, you confirm that:

• it is your own original work, or you have all necessary rights and permissions to share it;
• any person identifiable in a photo is an adult who has consented to it being shared;
• reviews reflect your honest, first-hand experience and disclose any incentive you received;
• it does not contain personal information about others, confidential information, or sexually explicit, offensive or unlawful material; and
• it does not infringe any third party's copyright, trademark, privacy, publicity or other rights.

License to Daffanny

You retain ownership of your Submissions. However, by posting a review or other public Submission on the Site, you grant Daffanny a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, reproduce, display, publish, translate, adapt (for example, cropping or resizing) and distribute that Submission in connection with the Site and our business, including in marketing. For photos you post on your own social media accounts, we will request your permission, typically by replying to your post, before reposting them on our channels or using them on the Site, and we will credit you where practical.

Messages to customer care

Messages you send to customer care are used to respond to your request and improve our service, and are handled in accordance with our Privacy Policy. They are not published.

Moderation

We may, but are not obliged to, review, edit for formatting, decline or remove any Submission at our discretion, for example if it breaches these Terms. We do not endorse Submissions, and opinions expressed by users are their own.

6. Feedback

We love hearing ideas about new styles, sizes, colors and Site features. If you send us suggestions, ideas or other feedback about our products or services ("Feedback"), you agree that we may use it freely for any purpose, without any obligation to keep it confidential, compensate you or credit you. Please do not send us Feedback that you consider confidential or proprietary, or that you expect to be paid for.

7. Third-Party Links and Services

The Site may contain links to, or integrations with, third-party websites and services, such as payment providers, shipping carriers and tracking pages, social media platforms and review tools. These are provided for your convenience only. We do not control and are not responsible for the content, policies, availability or practices of third-party sites and services, and a link does not imply our endorsement. Your use of third-party services is governed by their own terms and privacy policies, which we encourage you to read. Questions or complaints about a third party's products or services should be directed to that third party.

8. Availability and Changes to the Site

We aim to keep the Site available and running smoothly, but we do not guarantee that it will always be available, uninterrupted, timely or error-free. Access may be suspended or restricted temporarily for maintenance, updates, security reasons or events beyond our control.

We continually improve the Site and may add, change or remove features, content, products or services at any time without notice. We may also restrict access to some parts of the Site, or to the whole Site, to users in certain locations. We will not be liable to you if any part of the Site is unavailable at any time or for any period.

9. Disclaimers

The Site and all content, tools and information on it are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Daffanny disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement, with respect to the Site.

Content on the Site, including styling tips, fit advice, size recommendations and the bra size calculator, is provided for general information only. It is not professional, medical or health advice, and results depend on accurate measurements and personal preference. While we try to keep information accurate and current, we do not warrant that the Site is free of errors, viruses or other harmful components. Warranties that apply to products you buy from us are set out in our Terms of Service.

10. Limitation of Liability

To the fullest extent permitted by law, Daffanny and its owners, employees, agents, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, use or goodwill, arising out of or relating to your access to, use of, or inability to use the Site, any content on it, or any third-party conduct or content, whether based on contract, tort (including negligence), statute or any other legal theory.

To the extent any liability cannot be excluded, our total aggregate liability relating to your use of the Site (as opposed to purchases, which are addressed in our Terms of Service) will not exceed one hundred US dollars (USD $100).

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including for fraud, gross negligence, death or personal injury caused by negligence, or your mandatory rights as a consumer. You agree to indemnify Daffanny against claims arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.

11. Copyright Complaints (DMCA)

We respect the intellectual property rights of others and expect users of the Site to do the same. If you believe that material on the Site infringes your copyright, please send a written notice to our designated agent at [email protected] with the subject line "Copyright Notice". In accordance with the U.S. Digital Millennium Copyright Act (DMCA) and similar laws, your notice must include:

1. a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved;
3. identification of the material that is claimed to be infringing, with enough information for us to locate it, such as the specific URL;
4. your contact information, including your name, postal address, telephone number and email address;
5. a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the material and may notify the person who posted it.

Counter-notices

If you believe material you posted was removed by mistake or misidentification, you may send a counter-notice to [email protected] including your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; and your name, address, telephone number and consent to the jurisdiction of the appropriate court. We may restore the material unless the complainant notifies us that it has filed a court action.

Please note that knowingly making material misrepresentations in a notice or counter-notice may make you liable for damages. We may terminate the accounts of users who repeatedly infringe the rights of others. Written notices may also be sent to our registered business address, available on request via [email protected].

12. Suspension and Termination

We may suspend or terminate your access to the Site or your account, remove your Submissions, or refuse service at any time if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive activity, or created risk or legal exposure for Daffanny or other users. Where appropriate, we will tell you the reason. You may stop using the Site and ask us to close your account at any time.

On termination, your license to use the Site ends immediately. Sections that by their nature should survive termination, including those on intellectual property, Submissions licenses, disclaimers, limitation of liability, governing law and any outstanding order obligations, will continue to apply.

13. Governing Law and Changes to These Terms

These Terms and any dispute arising out of or in connection with your use of the Site are governed by the laws of the jurisdiction in which Daffanny is registered, without prejudice to mandatory consumer protections of your country of residence. We encourage you to contact us first so that we can try to resolve any concern informally; the dispute resolution process described in our Terms of Service also applies to disputes under these Terms. If you are a consumer, you may be entitled to bring proceedings in the courts of your country of residence.

We may revise these Terms from time to time. The current version will always be posted on this page with its "last updated" date, and for material changes we will provide reasonable notice, for example on the Site or by email. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If any provision is found unenforceable, the rest will remain in effect, and our failure to enforce a provision is not a waiver of it.
